Terms and Conditions

This legal notice applies to the entire contents of the website under the domain name www.painshill.co.uk and to any correspondence between you and us and to any newsletters or publications downloaded by you or sent to you by us (the "Site").

Painshill Park whose address is Portsmouth Road, Cobham KT11 1JE ("PP") is responsible for the Site.

In consideration of PP allowing you access to the Site you are deemed to accept our terms and conditions of use. Please read them carefully. If you do not accept these terms and conditions of use, do not use the Site.

Our terms and conditions of use may be changed. Please review them regularly. If you continue to use the Site after a change has been made to the terms and conditions of use you are deemed to have accepted it.

1. Use of the Site

PP owns the copyright and all other intellectual property rights in the material on the Site. You may not copy, reproduce, republish, download, post, broadcast, transmit, adapt or otherwise use any material on the Site other than for your own personal non-commercial use.

You may not use the Site:
- for the posting, uploading, emailing or other transmission of any material, the publication, dissemination, use or possession of which infringes the rights of any person or which is unlawful in any other respect;
- in any way which is abusive, defamatory or obscene or which will harass, distress or inconvenience any person or which might restrict or inhibit the use and enjoyment of the Site by any person;
- for the posting, uploading, emailing or other transmission of any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation or commercial exploitation;
- for the posting, uploading, emailing or other transmission of any material that contains software viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment;
- to create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from the Site, without written permission from PP;
- to transmit or re-circulate any material obtained from the Site to any third party, without written permission from PP;
- in such a way so as to remove the copyright or trade mark notice(s) from any copies of any material made in accordance with these terms;
- or o in any way that might bring PP into disrepute.

You must be at least 18 years of age or be accessing the Site with the full consent of a parent or guardian.

2. Removal of Material and Access to the Site

PP shall have the right to refuse to allow you access to the Site or any part of it at any time and for any reason without giving you any advance notice. 

PP shall have the right at any time and for any reason to remove from the Site any material posted, uploaded, emailed or otherwise transmitted by you without giving you any advance notice.

3. Viruses

Whilst effort has been taken to ensure that the Site is free from viruses, PP gives no warranties that it is indeed free from viruses and you are responsible for ensuring that you have installed adequate virus checking software.

PP shall not be responsible for any viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment or other material transmitted with or as part of the Site or any other internet site.

4. Links

Some of the pages on the Site include links to external websites. These are for your convenience only. PP does not endorse and is not responsible for the content of these external websites.

5. Intellectual Property Rights

PP may publish any material you submit, post, upload, email or otherwise transmit to it or to the Site at its sole discretion and it shall be entitled to make additions or deletions to any such material prior to publication.

You hereby grant PP a non-exclusive, royalty-free, perpetual and worldwide licence to republish any material you submit, post, upload, email or otherwise transmit to them or to the Site in any format including (without limitation) print and electronic format.

You hereby waive all of the moral rights that you have under Chapter IV of the of the Copyright, Design and Patents Act 1988 in respect of any material you submit, post, upload, email or otherwise transmit to PP or to the Site.

6. Personal Data

You agree to provide true, accurate, current and complete information about yourself in any registration or subscription form you complete. You agree to maintain and promptly update this Information to keep it true, accurate, current and complete.

PP is registered under, and will process your personal data in accordance with, data protection legislation.

You hereby agree that the Registration Information (and all updates of the Registration Information) and any other information sent to PP by you or otherwise obtained by PP about you ("the Personal Data") may be processed by PP for the purposes of:

(a) processing your requests;

(b) providing you with information about products and services of PP by email or other means (each screen that asks for data gives you the opportunity to opt out from receiving such data);

(c) providing a personalised service;

(d) maintaining accounts and records;

(e) statistical analysis and conducting market research surveys;

(f) assessing and evaluating the use that is being made of the Site;

and (g) information and databank compilation and administration.

We use the personal information you give us to develop our understanding of our visitors and to determine how best to serve them. We may use the information to send you E-Alert informing you of upcoming events and of Latest News at Painshill Park and for this reason each screen that asks for data gives you the opportunity to opt out of receiving such data.

We use return e-mail addresses to answer the e-mails we receive. Such addresses are not used for any other purpose and are not shared with outside parties.

We will not send your data to third parties.

You can access all your personal identifiable information that we collect online and maintain by logging in onto our website and by editing your personal details. Once logged on, you can correct factual errors in your personally identifiable information. You can also do it by contacting the website manager. To protect your privacy and security, we will also take reasonable steps to verify your identify before granting access and making corrections.

The website collects some anonymous information about you automatically as you move through the site. This information is used to help us monitor how you and other visitors use the site, allowing us to provide an improved service throughout the site. The information collected automatically does not, however, contain anything that can identify you personally. Some sections of the website may use cookies to store information on your local computer. These cookies do not contain any personal data; they only serve to provide you with information tailored to your individual needs.

7. Ticket Booking for a Park Event

(a) Cancellation: We do not offer refunds, cancellations or amendments to tickets. Refunds are only given if the Park is closed due to exceptional circumstances.

(b) Arrival Time: If you have booked for a timed event; please ensure you arrive at the car park at least 20 minutes BEFORE your booked time. (45 mins for FATHER CHRISTMAS when your time slot commences at the Wishing Tent and the walk to the grotto takes approx 20 mins).

(c) Tickets: Tickets are valid for all day entry to the park. Please book all your requirements early to avoid disappointment as tickets sell out quickly. For extra tickets a separate booking is required. Additional Adult tickets can be purchased.

(d) Children Supervision: Children must be accompanied by an Adult. Maximum of 4 child tickets per Adult. Child only tickets cannot be purchased. (exception for Camp Hamilton)

(e) Members: Painshill Park Members are required to show a valid Membership Card.

(f) Clothing: Painshill Park is an outdoor attraction. We suggest strong shoes and warm waterproof clothing. (For FATHER CHRISTMAS and other events by night, although there is a lit route during the evening visits, visitors may enjoy bring torches).

(g) Pushchairs: For safety reasons pushchairs may not be taken into the Grotto. May be left at the owners risk at the entrance to the Grotto.

(h) Tea Room and Shop: We offer hot and cold drinks, light snacks and cakes. Our shop stocks our award winning wine and a wide selection of seasonal gifts. (Except for FATHER CHRISTMAS, open 10.30am to 7.00pm Note: Christmas Eve until 4.00pm).

(i) Directions: From M25 J10 and the A3 Northbound, exit at junction with A245 towards Cobham. Entrance to free car park is in Between Streets, Cobham A245.

(j) Dogs: Dogs are not allowed through the Wishing Tent or Grotto.

(k) Fundraising: Father Christmas, our Holiday Adventures and Camp Hamilton are sponsored fundraising events for the restoration of Painshill Park.

(l) Special Needs: If any of your party is disabled and requires assistance, please book by telephone.

8. Changes to the Terms and Conditions of Use

Our terms and conditions of use may be changed. Please review them regularly. If you continue to use the Site after a change has been made you are deemed to have accepted it.

9. Liability: 

Whilst every effort has been taken to ensure the accuracy of the information on the Site, no warranty is given as to its accuracy or completeness. 

PP cannot guarantee that you will have uninterrupted access to the Site.

Notwithstanding anything else in these terms and conditions of use, to the fullest extent permitted by law PP excludes all warranties (whether express or implied) and all liability to you in respect of the Site, its content and your use of it.

10. Law and Jurisdiction

These terms and conditions of use shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales. 

If any of these terms or conditions of use should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions of use shall survive and continue to be binding and enforceable.
